Tourist licence in Spain: can you get one? The answer for almost 100 coastal towns

Can you still get a tourist licence (vivienda de uso turístico) in your coastal town? For anyone applying now, Málaga city, Alicante city, Valencia city and most Catalan resorts are currently closed or almost closed. In the Región de Murcia and much of the Costa del Sol we found no municipal freeze. Below is the short answer for each town, as of October 2026.

Coastal town on the Spanish Mediterranean with apartments and villas

Whether a property may be let to tourists varies in Spain from one municipality to the next, and sometimes from one neighbourhood to the next.

Whether you may let a property in Spain to tourists depends on three layers: the community of owners, the region and the municipality. Since 3 April 2025, new tourist rentals in an apartment building require the express consent of 3/5 of the owners (art. 7.3 and 17.12 Ley de Propiedad Horizontal) (Sepín). The region handles registration, and the municipality may set limits by neighbourhood or building. That last layer varies most from town to town, and it is what this page is about.

How to check all three layers for a specific property, which types of rental exist and what happens to an existing licence when you buy are covered in Holiday rentals in Spain: can this property be let?

Below is the short answer for each town, as of October 2026. The regions follow our usual order, from the Costa del Sol to the Costa Dorada.

Two things apply everywhere, so we do not repeat them for each town: an apartment in a building needs the consent of 3/5 of the community of owners, and the regional rules always apply. Where we found no municipal restriction, the municipality can still say no; in the Comunitat Valenciana it decides property by property through the compatibility report. Municipal rules change quickly, so always check them for your property.

Can I get a tourist licence for an apartment in Málaga?

No, not as a new applicant. Since 25 July 2026 the whole city of Málaga has had a freeze of up to three years on new tourist rentals on land zoned for residential use. Existing licences remain valid, and applications made before 24 July 2026 are handled under the old rules (Ayuntamiento de Málaga, Euro Weekly News).

Can I get a tourist licence for a villa or apartment in Marbella?

Yes, in principle. Marbella has no general freeze and is accepting new applications (Euro Weekly News). For an apartment you need the consent of the community of owners, and a villa with AFO status is ruled out.

Can I get a tourist licence for a villa or apartment in Estepona?

Yes, in principle. Estepona has no freeze and no cap per zone (Directimo). As elsewhere in Andalusia, a property with AFO status is ruled out.

Can I get a tourist licence for a villa in Benahavís or Casares?

Yes, in principle. For Benahavís and Casares we found no municipal freeze or cap. A detached villa does not need the neighbours' permission, but it does need to be registered with the Junta de Andalucía, and a villa with AFO status is ruled out.

Can I get a tourist licence for an apartment in Mijas?

Yes, in principle. Mijas has no freeze like the one in Málaga city, and we found no municipal bylaw or council resolution on tourist rentals. Sources differ on additional conditions: Euro Weekly News and Solprop report that Mijas sets conditions for new licences, without saying which, while Directimo reports that Mijas has no bylaw (Euro Weekly News, Directimo); check before you make an offer.

Can I get a tourist licence for an apartment in Fuengirola?

For an apartment in a residential block, usually not. Since February 2024 Fuengirola, on the basis of its zoning plan, has only registered tourist rentals with their own access from the street, and in August 2024 it asked the Junta to remove some 600 properties without their own access from the register (Ayuntamiento de Fuengirola). A villa or terraced house with its own front door onto the street does meet that requirement.

Can I get a tourist licence for an apartment in Benalmádena?

At the moment, yes. Benalmádena has no freeze or cap, but it is studying limits per zone after the council mapped where most tourist rentals are located (Directimo). Bear in mind that this may change.

Can I get a tourist licence for an apartment in Torremolinos?

Yes, in principle. Torremolinos has no freeze and, unlike Fuengirola, no requirement for separate access (Solprop).

Can I get a tourist licence for a property in Rincón de la Victoria?

For now, yes, but that may change. In November 2024 the council announced that it would restrict new tourist rentals through the zoning plan and a bylaw (101TV). Check with the town hall whether those rules already apply.

Can I get a tourist licence for an apartment in Nerja or Torre del Mar?

Yes, in principle. For Nerja and for Vélez-Málaga, which covers Torre del Mar, we found no municipal freeze or cap (Directimo).

Can I get a tourist licence for a property in Manilva?

Probably not as a new applicant, but the exact rules are unclear. According to Solprop, a municipal freeze on new tourist rentals has applied since December 2025, and according to ShortTermRentalz it lasts three years. The law firm Welex describes a bylaw with three zones: no new tourist rentals in the saturated zone A, while zones B and C still allow them, with restrictions by property type (Welex, ShortTermRentalz). We found no council resolution and no publication in the BOP Málaga. On its own website the council only reports that it started work on a bylaw in September 2024 (Ayuntamiento de Manilva). Ask the town hall which rule applies to your address.

Can I get a tourist licence for a villa in Sotogrande?

Probably yes, but check with the town hall. San Roque, which covers Sotogrande, announced in April 2025 that for six months it would stop cooperating with the registration of new tourist rentals (Ayuntamiento de San Roque). That announcement did not mention a formal decision, such as a suspension of licences. When we checked again in October 2026, we found no later decision or extension either. Nor did we find any rules from Sotogrande itself; for a property in an urbanisation, also look at the community's statutes.

Can I get a tourist licence for a villa in Alhaurín el Grande or Alhaurín de la Torre?

Yes, in principle. For both municipalities we found no municipal freeze or cap; since 2025 Alhaurín el Grande has been working with the Junta on inspections of tourist rentals (Andalucía Información). If the villa is on rural land, first check that it does not have AFO status, because if it does, it is ruled out.

Can I get a tourist licence for an apartment in Dénia?

Yes, but in the centre only within a cap per zone. In August 2026 Dénia gave final approval to a bylaw: in the most protected residential areas only 1% of homes may be tourist rentals, and in the zone between the Camí del Llavador and the beach 25% (idealista). Les Marines, Les Rotes and the Montgó fall outside the bylaw; there you only need the standard compatibility report. In the centre a freeze on new reports and licences had applied since August 2024, which the town council extended by a year in July 2025, with effect from 12 September 2025 (AlicantePlaza). When we checked in October 2026, we found no publication of the new bylaw in the BOP Alicante; ask the town hall whether the bylaw is already in force.

Can I get a tourist licence for a villa or apartment in Jávea?

For a villa, in principle yes; for an apartment it was not yet possible in early 2026. Xàbia suspended compatibility reports for apartments in September 2024 and has been issuing reports for villas again since September 2025 (Spanish Property Insight). In September 2025 the municipal planning committee proposed extending the freeze for apartments by six months (El Periòdic). In February 2026 there was a proposal for a cap per zone, such as 7% in the historic centre, 15% in Duanes and 25% in Tossalet (Javea.com). When we checked in October 2026, we found no later decision on the freeze or the caps, so ask what applies now.

Can I get a tourist licence for a villa in Cumbre del Sol?

Possibly; that is decided property by property, through the compatibility report, by the municipality of Benitatxell, which covers Cumbre del Sol. We found no municipal freeze.

Can I get a tourist licence for a villa in Moraira?

Possibly; the municipality of Teulada-Moraira decides property by property through the compatibility report. When we checked, we found no municipal freeze like those in Xàbia or Altea.

Can I get a tourist licence for a villa in Benissa?

Possibly, with a favourable compatibility report. We found no municipal freeze. Benissa is, however, working on a new zoning plan (Plan General Estructural), which was open for public consultation in July 2026 (El Periòdic); ask whether that changes anything for your property.

Can I get a tourist licence for an apartment in Calpe?

Yes, if the town hall issues a favourable compatibility report. Calp has no general freeze. The only thing the council put on hold, in June 2024 for two years, was the conversion of commercial premises into tourist rentals (elDiario.es).

Can I get a tourist licence for a villa in Jalón or Llíber?

Possibly; the municipality (Xaló or Llíber) decides property by property through the compatibility report. We found no municipal freeze. If the villa is on rural land, the report depends on what the zoning plan allows there.

Can I get a tourist licence for a villa or apartment in Altea?

Not in the central neighbourhoods or on the seafront; possibly in a number of urbanisations. Altea suspended the reports in January 2024 and is working on a bylaw. The January 2026 draft excludes areas including the seafront promenade, the Ensanche and Cap Negret, and allows rentals in areas including Altea la Vella, Mascarat Sud and Les Galeres, up to a combined 12% of homes (AlicantePlaza). When we checked, that bylaw was not yet final.

Can I get a tourist licence for a villa in Albir (l'Alfàs del Pi)?

That depends on the type of property, and the rules are not yet final. L'Alfàs del Pi suspended compatibility reports from 6 September 2024 for a maximum of two years, so until early September 2026 at the latest, and is working on a bylaw (Ajuntament de l'Alfàs del Pi). According to the June 2026 documents, the town council had not yet given the draft initial approval, and when we checked in October 2026 we found no approval since then (memoria justificativa). The draft allows rentals in detached villas whose façades are at least 10 metres from the side boundaries, in terraced houses and in apartment buildings, but not in semi-detached houses. In an apartment building, only for the whole building or with the express consent of the community of owners (draft bylaw).

Can I get a tourist licence for a villa in La Nucía or Polop?

In La Nucía possibly; in Polop, under the provisional bylaw, only in the urbanisations outside the village. In La Nucía we found no municipal freeze. Polop suspended new reports in May 2024 and gave initial approval to a bylaw in early 2026: no more tourist rentals in the historic centre, and in the urbanisations a maximum of 15% of homes per area, with the consent of the community of owners (AlicantePlaza, Murcia Today). When we checked in October 2026, we found no final approval. According to AlicantePlaza, the May 2024 freeze applied for one year, with an extension of one year at most, so ask the town hall which rules apply now.

Can I get a tourist licence for an apartment in Benidorm?

Yes, in most parts of the city. Benidorm continues to issue compatibility reports and allows tourist and residential use in the same building, provided the apartment is at least 38 m² or has its own parking space (AlicantePlaza). In low-density residential areas the council has issued unfavourable reports since 2019.

Can I get a tourist licence for a property in Finestrat?

Not for now. In March 2025 Finestrat suspended new compatibility reports while the council draws up a bylaw on where tourist rentals will still be allowed, with La Cala and the urbanisations as the focus (AlicantePlaza). We found no end date for the freeze.

Can I get a tourist licence for an apartment in Villajoyosa?

Yes, in principle, with a favourable compatibility report. In 2024 La Vila Joiosa looked into a freeze for apartments in buildings with a community of owners but did not introduce one, and as far as we could find, a proposal for a moratorium from March 2025 was not adopted (AlicantePlaza).

Can I get a tourist licence for an apartment in El Campello?

Possibly, but first check what applies now. In September 2024 El Campello suspended compatibility reports for one year for apartments and for houses with shared areas or a community of owners; a detached house with neither was not affected (AlicantePlaza). We found nothing on whether the freeze has been extended or replaced by new rules.

03Costa Blanca South

Can I get a tourist licence for an apartment in Alicante city?

No, not for now. In January 2025 Alicante suspended new tourist rentals across the whole municipality, and in February 2026 a court dismissed the appeal against that decision (esdiario). An amendment to the zoning plan with a cap per neighbourhood and a requirement for separate access in residential buildings received initial approval in December 2025; the council expects final approval before the end of 2026 (Ayuntamiento de Alicante).

Can I get a tourist licence for an apartment in Santa Pola?

Yes, in principle, with a favourable compatibility report. We found no municipal freeze in Santa Pola. In June 2025 the opposition proposed cutting the number of tourist rentals by 75%, but we found no decision on it (AlicantePlaza).

Can I get a tourist licence for an apartment in Arenales del Sol?

Yes, in principle. Elche, which covers Arenales del Sol, rejected a proposal to regulate tourist rentals in 2024. Of the 950 registered tourist rentals in the municipality at the time, 671 were in Arenales del Sol (AlicantePlaza).

Can I get a tourist licence for a property in Guardamar del Segura?

Possibly; the municipality decides property by property through the compatibility report. For Guardamar we found no municipal freeze like the one in Alicante city. Apply for the report before you make an offer.

Can I get a tourist licence for an apartment in Torrevieja?

Yes, if the community of owners agrees and the town hall issues a favourable compatibility report. Torrevieja's zoning plan allows tourist use in almost the entire municipality (AlicantePlaza), and the council focuses mainly on enforcement against illegal rentals (El Español).

Can I get a tourist licence for an apartment in Orihuela Costa?

Yes, with a favourable compatibility report from the municipality of Orihuela and the consent of the community of owners. We found no municipal freeze; in June 2026 Orihuela had 4,567 tourist rentals in the regional register (AlicantePlaza).

Can I get a tourist licence for a property in Pilar de la Horadada?

Possibly, if the zoning plan allows tourist use at that location. We found no general municipal freeze, but the outcome depends on the zone the property is in; apply for the compatibility report before you make an offer.

Can I get a tourist licence for a villa in Ciudad Quesada, Algorfa or San Miguel de Salinas?

Possibly; the municipality (Rojales, Algorfa or San Miguel de Salinas) decides property by property through the compatibility report. We found no municipal freeze for these three municipalities. If the villa is in an urbanisation set up as a single community of owners, the 3/5 rule in principle applies there too; how that works is explained in our guide to holiday rentals.

04Costa de Valencia

Can I get a tourist licence for an apartment in Valencia?

No, not in practice. Since March 2026 a new tourist rental in Valencia city is only allowed on the ground floor or the first floor, below the residential floors and with its own access from the street. Once 2% of the homes in a neighbourhood are tourist rentals, it stops altogether (Ajuntament de València, RSM). The rules apply throughout the municipality, including beach districts such as the Malvarrosa, El Saler and Pinedo.

Can I get a tourist licence for a villa near Valencia, such as in L'Eliana or Bétera?

Possibly; it depends on the municipality. Valencia city's rules do not apply there. You do need the regional registration and a favourable compatibility report from the municipality.

Can I get a tourist licence for a property in Paterna or La Cañada?

Only under strict conditions. In June 2026 Paterna approved rules that only allow tourist rentals in a residential building on the ground floor, with the consent of the community of owners and a dedicated parking space (El Periòdic). According to Brainsre, public transport nearby and a cycle lane within 100 metres are also required, and Paterna bans new blocks of tourist apartments throughout the municipality. The suspension of new licences for hotel and tourist use from August 2024 applied for a maximum of two years (Valencia Plaza). None of the reports says whether the June 2026 approval was initial or final, and none of them mentions detached villas. So check with the town hall whether the rules already apply and what they mean for a villa in La Cañada.

Can I get a tourist licence for an apartment in Port Saplaya or Patacona?

Possibly, with a favourable compatibility report from the municipality of Alboraya, which covers both areas. Valencia city's rules do not apply here, and we found no municipal freeze in Alboraya.

Can I get a tourist licence for an apartment in Puçol?

Possibly, with a favourable compatibility report from the municipality. We found no municipal freeze in Puçol.

Can I get a tourist licence for an apartment in Port de Sagunt?

Yes, but not on the ground floor of an apartment building. Since October 2025 Sagunto's zoning plan no longer allows tourist rentals on the ground floor of a residential building, except in one zone (Z.9); on the upper floors they are allowed (Ajuntament de Sagunt). There is no cap per neighbourhood or building. That is the exact opposite of Valencia city, where only the ground floor and the first floor still qualify.

Can I get a tourist licence for an apartment in Cullera or Oliva?

Yes, in principle, with a favourable compatibility report. For Cullera and Oliva we found no municipal freeze or cap.

Can I get a tourist licence for an apartment in Gandia?

Possibly; Gandia assesses it plot by plot. There is no general freeze, but the council refuses the compatibility report if tourist use on that plot does not fit the zoning plan, as a 2026 complaint to the Síndic de Greuges, the regional ombudsman, shows (Síndic de Greuges).

Can I get a tourist licence for an apartment in Benicàssim?

Yes, in principle. We found no municipal freeze; in May 2026 Benicàssim had 968 tourist rentals in the regional register (Castellón Plaza).

Can I get a tourist licence for an apartment in Oropesa del Mar?

Yes, in principle. With 3,167, Oropesa del Mar has the most tourist rentals in the province of Castellón, and we found no municipal freeze (Castellón Plaza).

Yes, in principle. For Alcalà de Xivert, which covers Alcossebre, and for Peníscola we found no municipal freeze. In May 2026 Alcalà de Xivert had 2,173 tourist rentals (Castellón Plaza).

05Costa Cálida

Can I get a tourist licence for a villa in San Pedro del Pinatar?

Yes, in principle. In the Región de Murcia you notify the Instituto de Turismo and have the property entered in the regional register; you put the number in every advert. We found no municipal restriction. A detached villa without a community of owners does not need the neighbours' permission; a villa in a complex with a community of owners does.

Can I get a tourist licence for an apartment in Santiago de la Ribera or Los Alcázares?

Yes, in principle. For San Javier, which covers Santiago de la Ribera, and for Los Alcázares we found no municipal freeze, cap or bylaw for tourist rentals. You register the property with the Instituto de Turismo, and for an apartment you need the consent of the community of owners.

Can I get a tourist licence for an apartment in La Manga or Cabo de Palos?

Yes, in principle. Cartagena, which covers Cabo de Palos and the southern part of La Manga, has no bylaw, freeze or cap for tourist rentals; an opposition party has been calling for one since 2020, and did so again in May 2025 (Ayuntamiento de Cartagena). The northern part of La Manga falls under San Javier, where we did not find any restriction either.

Can I get a tourist licence for an apartment in Mazarrón or Águilas?

Yes, in principle. For Mazarrón and Águilas we found no municipal restriction. You register the property with the Instituto de Turismo and put the registration number in every advert.

Can I get a tourist licence for a villa on a golf resort such as Mar Menor Golf, La Torre Golf or Condado de Alhama?

Yes, in principle, if the resort's community of owners agrees. For the municipalities of Torre-Pacheco, Murcia and Alhama de Murcia we found no municipal restriction. At La Torre Golf the community voted in January 2026 to allow tourist rentals (Murcia Today); for Condado de Alhama we found no such decision, so ask for the statutes and the minutes there.

06Costa Brava

All the towns below are on the list of 262 Catalan municipalities. A new licence is only possible there if the municipal plan expressly allows tourist rentals; until the municipality has amended its plan, it issues no new licences (Generalitat de Catalunya). In addition, a municipality may never grant more than 10 licences per 100 inhabitants. That cap applies per municipality: the law sets no cap per zone, and the municipality allocates the licences publicly and competitively (BOE). If a municipality is already above the cap, there is no room for new licences (Osborne Clarke). Existing licences expire on 9 November 2028 unless they have been renewed in time. In June 2026 the Catalan parliament rejected a proposal to repeal the scheme (que.es).

Can I get a tourist licence for an apartment or villa in Lloret de Mar?

Possibly: according to the 2023 calculation, Lloret de Mar was below the cap, so new licences are not ruled out (El Punt Avui). The council takes a hard line on illegal rentals, with fines of €20,000 per property (Catalan News).

Can I get a tourist licence for a property in Tossa de Mar?

Only in certain zones. Since 2021 Tossa has had its own plan with a maximum of 1,522 tourist rentals, spread over five zones: zone 1 gets no new ones, and zone 3, with the urbanisations of Pola-Giverola and Salionç, at most 173 more (El Punt Avui). In 2026 the Catalan courts annulled part of the plan (Diari de Girona); ask what applies to your address.

Yes, if the municipal plan allows it. Blanes is well below the cap: with around 40,000 inhabitants, there is room for 4,000 tourist rentals (3Cat).

Can I get a tourist licence for an apartment in Sant Feliu de Guíxols?

Not for now. Sant Feliu de Guíxols is below the cap, but since November 2023 it has not issued any new licences, and will not until the municipal plan has been amended (Ràdio Sant Feliu). In July 2024 that plan was not yet in place; we found no more recent report.

Can I get a tourist licence for an apartment in Platja d'Aro?

No, not for now. In 2024 Castell-Platja d'Aro had some 2,900 tourist rentals for around 12,500 inhabitants, more than twice the cap, and it suspended new licences in November 2023 (Pla Local d'Habitatge).

Can I get a tourist licence for an apartment in L'Escala?

No, not as a new applicant. L'Escala has some 3,200 tourist rentals; to get below the cap, 2,203 of them would have to go. The council opposes the scheme (3Cat).

Can I get a tourist licence for an apartment in Roses?

Can I get a tourist licence for a property in Cadaqués?

No. Cadaqués is far above the cap: according to the calculation, 71% of its tourist rentals would have to go (3Cat).

Can I get a tourist licence for an apartment in La Pineda?

Possibly: in 2023 Vila-seca, which covers La Pineda, was below the cap with 6.5 tourist rentals per 100 inhabitants (Tarragona Digital). So a new licence is possible if the municipal plan allows it.

Can I get a tourist licence for an apartment in Tarragona or Altafulla?

Only if the municipal plan allows it and there is still room under the cap. Tarragona and Altafulla are both on the list of 262; we found no recent decision by either municipality, so ask the town hall about the current situation.

Can I get a tourist licence for an apartment in Torredembarra?

Not for now. Torredembarra has issued no new licences since 2023 and is working on a bylaw and a plan setting out in which zones tourist rentals will still be allowed (Diari de Tarragona).

Can I get a tourist licence for an apartment in Cunit or Creixell?

Yes, and in principle more easily than in the neighbouring municipalities. Cunit and Creixell are not on the list of 262, so the cap of 10 per 100 inhabitants and the 2028 end date do not apply there (Generalitat de Catalunya). You do still register the property with the town hall, which passes the details on to the Catalan tourism register, and here too the zoning plan can restrict tourist rentals (Ajuntament de Cunit).

Can I get a tourist licence for an apartment in Sitges?

Only through a lottery and within a cap per zone. Since 2021 Sitges has allowed a maximum of 10% tourist rentals in zone A (including the old town, Sant Sebastià and Aiguadolç), 7% in zone B and 9% across the whole municipality. Licences are allocated by lottery and only apply to an entire property (Ajuntament de Sitges).

Possibly, within a cap of its own. Vilanova i la Geltrú is well below the cap of 10 per 100 inhabitants, but in 2021 the town council approved its own plan limiting tourist rentals to 2.46% of all homes, around 800 (Vilanova Blog). According to the mayor, many of them are villas and second homes in Les Tres Cales, Calafat and Sant Jordi (Diari de Tarragona).

Frequently asked questions

My town is not on this page. How do I find out?

Ask the municipality's urbanismo (planning) department whether there is a freeze or a cap per neighbourhood. In the Comunitat Valenciana, also ask whether the municipality will issue a compatibility report for that property, and in Catalonia, check whether the municipality is on the list of 262.

Does the tourist licence transfer to me when I buy the property?

Not automatically everywhere. In the Comunitat Valenciana a new owner registers the property again, including a new compatibility report (Andersen). How it works in the other regions is explained in our guide to holiday rentals.

Why can the answer differ within a single municipality?

Municipalities may set limits by zone or neighbourhood, as Dénia and Altea do. In addition, the municipality checks plot by plot whether tourist use fits the zoning plan. Two properties in the same municipality can therefore get different answers.

Whether a property may be let is one of the points we check when you buy; what else is involved is covered in the guide Buying a home in Spain. Do you have your eye on a property you would like to let out part of the time? Book a no-obligation conversation and we will find out, before you make an offer, what the community of owners, the region and the municipality allow.
