Our arrangements in writing

These terms and conditions apply to all engagements and agreements between Costa Management BV (trading under the name Costa Select) and its clients. We have written them in plain language, so you know where you stand.

Applicability

These terms and conditions apply to all engagements and agreements between Costa Management BV, trading under the name Costa Select (hereinafter "Costa Select", "we", "us"), established at Daam Fockemalaan 22 - lokaal 042, 3818 KG Amersfoort, KVK 96824522, and the client (hereinafter "you", "client"). Our purchase guidance in Spain is provided through our Spanish partner Stam Immo Group SL, registered under RAICV 1292, ASAPI 556 and APIAL A-135. By giving us an engagement, you agree to these terms.

Deviations from these terms are only valid if agreed in writing. The applicability of any general terms and conditions of the client is expressly excluded.

The engagement

We act as a buyer's agent and represent only the interests of the buyer. We do not accept engagements from sellers.

The engagement covers searching for, assessing and helping to acquire Spanish residential property according to the search profile agreed between the parties. The scope and specific terms of each engagement are set out in a separate engagement agreement.

Fee and payment

Our fee is a percentage of the purchase price, with a minimum amount for smaller purchases. We set the exact percentage per engagement in the individual engagement agreement, so you know in advance where you stand.

Costs of third parties engaged (such as a notary, lawyer or technical surveyor) fall outside our fee and are invoiced separately.

Cooperation and duty to inform

For the proper performance of the engagement, you are required to provide all information that we reasonably need. Incorrect or incomplete information may delay or hinder performance and may lead to additional costs.

During an active engagement, you inform us immediately of any changes in your situation (budget, region preference, timing) that may affect the search process.

Duration and termination

An engagement is entered into for the time needed to complete a purchase, with an expected duration of four to six months. Extension takes place by mutual agreement.

Either party may terminate the engagement at any time in writing, without a notice period. Because we work on a no cure, no pay basis, in the event of early termination you owe no fee as long as no purchase has been completed. Costs of third parties already engaged (notary, lawyer, technical surveyor) are, however, invoiced separately.

Liability

We carry out our work to the best of our ability and with the care you may expect from a professional buyer's agent. Our liability is limited to the amount that is paid out in the relevant case under our professional liability insurance, increased by the excess.

We are not liable for:

  • Errors or omissions of third parties engaged by you (notary, lawyer, mortgage adviser)
  • Damage caused by incomplete or incorrect information from you or from the seller
  • Market developments, price drops or changes in regulations after the purchase
  • Indirect damage, consequential damage, lost profit or non-material damage

Complaints and disputes

Do you have a complaint? Report it directly via info@costaselect.com. Submit a written complaint within two months of discovery and you will receive a substantive response within four weeks.

Spanish law applies to all agreements with Costa Select. If we cannot resolve the matter together, we submit the dispute to the competent court in Spain (province of Alicante).

Amendment of terms

We reserve the right to amend these terms and conditions. Amendments apply only to new engagements and have no retroactive effect on ongoing engagements. The most current version is always available on this page.
